§ 18.1401. Eligible road rights-of-way.

  • Notwithstanding the provisions of subtitle 1 of this title, a road right-of-way is eligible to be constructed as part of a capital project under this subtitle if:

    (1)

    The existing road right-of-way was not accepted into the County road system as a prescriptive road by resolution of the County Council;

    (2)

    The road right-of-way is located in a subdivision that was not subject to subdivision regulations or a developer agreement with the County at the time of plat recordation;

    (3)

    The road right-of-way has been included in a capital project by the Director under section 18.1402 of this subtitle; and

    (4)

    The road right-of-way will be, when constructed, open to the public.
