§ 18.306. Penalties.

  • (a)

    Criminal Penalties. Any person who violates any provision of this subtitle, or any rule, regulation, order or permit issued under this subtitle, is guilty of a misdemeanor and upon conviction is subject to a fine not exceeding $1,000.00, or imprisonment not exceeding six months, or both, for each violation. Each day a violation occurs or continues is a separate offense. Costs may be imposed at the discretion of the court.

    (b)

    Civil Penalties. A violation of this subtitle is a Class A offense and any person who violates any provision of this subtitle, or any rule, regulation, order, or permit issued under this subtitle, is subject to a civil penalty up to $1,000.00 for each violation. Each day a violation occurs or continues is a separate offense.
