§ 18.902A. Requirement to provide stormwater management measures, exemptions.

  • (a)

    Requirement to Provide. A person shall not develop any land for residential, commercial, industrial, or institutional uses without providing stormwater management measures that control or manage runoff from such developments, except as provided within this subtitle. Stormwater management measures must be designed consistent with the design manual and constructed according to an approved plan for new development or redevelopment.

    (b)

    Exemptions. Stormwater management is not required for:

    (1)

    Additions or modifications to existing single-family detached residential structures that do not disturb over 5,000 square feet of land area;

    (2)

    Developments that disturb less than 5,000 square feet of land area;

    (3)

    Land development activities which are regulated under specific State laws regarding the management of stormwater; or

    (4)

    Agricultural land management practices.
