§ 20.1100. Purpose; applicability.

  • (a)

    Purpose. To protect the public health, safety, and welfare, the County's Stormwater Management, Storm Drainage, and Water Quality Programs must be supported by an adequate, sustainable source of revenue. All real property in the County, including property owned by tax-exempt entities, benefits from these County programs and services. Further, those with higher amounts of uncontrolled impervious area contribute greater amounts of stormwater or pollutants to the County's stormwater management facilities, storm drains, and streams, and therefore should carry a proportionate burden of the cost. Therefore, the County has determined that it is in the interest of the public to enact a watershed protection and restoration fee that allocates program costs to all owners of improved real property based on impervious surface measurement, as described in this subtitle.

    (b)

    The watershed protection and restoration fee shall be charged on all improved property in the County, except for property exempted under Section 4.202.1 of the Environment Article of the Annotated Code of Maryland.
